Terms of Service — Nordlys Fotostudio
These Terms of Service govern the use of services provided by Nordlys Fotostudio, a photo-studio located at Torggata 12, 0181 Oslo, Norway, and apply to all clients who book, purchase, or otherwise use our services. By making a booking, paying a deposit, attending a session, or otherwise engaging our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
1. Introduction and acceptance of terms
These Terms of Service constitute a binding agreement between the client and Nordlys Fotostudio. They apply to all services offered by Nordlys Fotostudio unless otherwise agreed in writing. If the client books on behalf of another person, the person making the booking confirms that they are authorized to accept these terms on behalf of all participants.
If any additional written agreement, quotation, order confirmation, or service-specific conditions are provided by Nordlys Fotostudio, those terms shall apply in addition to these Terms of Service. In the event of conflict, any expressly agreed written terms shall prevail to the extent permitted by applicable law.
2. Scope of services
Nordlys Fotostudio provides professional photography services, including but not limited to:
- Portrettfotografering
- Familiefotografering
- Bedriftsportretter og profilbilder
- Produktfotografering for nettbutikk
- Bryllups- og forlovelsesfotografering
- Nyfødt- og barnefotografering
Services may include pre-session consultation, photography session time, image selection, post-processing, retouching, delivery of digital files, and, where agreed, printed products or albums. The exact scope, deliverables, timing, and pricing will be set out in the relevant booking confirmation, quotation, or service agreement.
Any sample images, portfolios, or promotional materials are illustrative only and do not guarantee identical results. Artistic style, composition, lighting, editing, and final selection are subject to professional judgment by Nordlys Fotostudio.
3. User obligations and responsibilities
The client agrees to:
- Provide accurate and complete information when booking or communicating with Nordlys Fotostudio.
- Arrive on time for scheduled sessions and follow reasonable instructions given by Nordlys Fotostudio.
- Ensure that all participants, including children and guests, are appropriately supervised and prepared for the session.
- Obtain all necessary consents for any person appearing in the photographs, including parental or guardian consent where required.
- Respect studio equipment, premises, staff, and any third-party property used during the session.
- Not bring hazardous, illegal, or disruptive items or engage in conduct that may endanger persons, property, or the quality of the session.
For sessions involving minors, the parent or legal guardian is solely responsible for the child’s safety, conduct, and consent to photography. For business and product photography, the client is responsible for ensuring that products, branding materials, and any supplied content do not infringe third-party rights and comply with applicable laws.
If the client fails to comply with these obligations, Nordlys Fotostudio may suspend, reschedule, or terminate the session without liability for any resulting loss, subject to mandatory consumer law rights where applicable.
4. Payment terms and conditions
Prices are stated in Norwegian kroner (NOK) unless otherwise indicated and may include or exclude applicable taxes depending on the service and the client’s status. The applicable price will be confirmed at the time of booking or in the quotation issued by Nordlys Fotostudio.
- A deposit or advance payment may be required to secure a booking.
- The remaining balance, if any, must be paid by the due date stated in the invoice or booking confirmation.
- Accepted payment methods may include bank transfer, card payment, or other methods specified by Nordlys Fotostudio.
- Late payments may incur reminder fees, statutory interest, and collection costs to the extent permitted by applicable law.
Unless otherwise agreed in writing, no final deliverables, including digital files or printed products, will be released until full payment has been received. Any additional work requested by the client beyond the agreed scope may be charged separately.
5. Cancellation and refund policy
Bookings may be cancelled or rescheduled according to the following principles, subject to mandatory consumer protection rules and any specific written agreement:
- If the client cancels well in advance, Nordlys Fotostudio may, at its discretion, offer a rescheduling option or partial refund of any prepaid amount, less reasonable administrative costs and any non-recoverable expenses.
- If the client cancels shortly before the session, the deposit may be retained to cover reserved time and preparation costs.
- If the client fails to attend a scheduled session without notice, the full session fee or deposit may be forfeited.
- If Nordlys Fotostudio must cancel due to illness, equipment failure, safety concerns, or other legitimate reasons, the client will be offered a rescheduled session or a refund of amounts paid for services not yet delivered.
Refunds do not apply to services already performed, edited images already delivered, or custom products already produced, except where required by mandatory law or where Nordlys Fotostudio agrees otherwise in writing. Wedding, event, and time-sensitive bookings may be subject to separate cancellation terms stated in the booking confirmation.
6. Liability limitations
Nordlys Fotostudio shall perform services with reasonable skill and care. However, to the maximum extent permitted by law, Nordlys Fotostudio shall not be liable for indirect, incidental, special, or consequential losses, including loss of profit, loss of business, loss of goodwill, or loss of anticipated savings.
Nordlys Fotostudio is not responsible for:
- Delays or failures caused by the client, participants, suppliers, or third parties.
- Loss or damage to personal belongings brought to the studio or location, except where caused by Nordlys Fotostudio’s gross negligence or wilful misconduct.
- Unsatisfactory results arising from inaccurate instructions, poor cooperation, unsuitable weather, venue restrictions, or circumstances outside our control.
- Technical issues caused by internet service providers, hosting platforms, or third-party delivery services.
Nothing in these Terms of Service excludes or limits liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under applicable law.
Where liability cannot be excluded, Nordlys Fotostudio’s total aggregate liability for any claim arising out of or in connection with the services shall, to the extent permitted by law, be limited to the amount paid by the client for the specific service giving rise to the claim.
7. Intellectual property rights
Unless otherwise agreed in writing, all copyrights and related intellectual property rights in photographs, edits, previews, contact sheets, and other creative materials produced by Nordlys Fotostudio remain with Nordlys Fotostudio or its licensors.
Upon full payment, the client receives a non-exclusive, non-transferable license to use the delivered images for the purposes agreed at booking or reasonably implied by the service type. Unless expressly agreed otherwise, the client may not:
- Sell, sublicense, or commercially exploit the images beyond the agreed use.
- Alter, crop, filter, or edit the images in a way that misrepresents the work or harms the reputation of Nordlys Fotostudio.
- Remove watermarks, metadata, or copyright notices where present.
Nordlys Fotostudio may retain copies of images for archival, backup, quality control, and portfolio purposes, subject to applicable privacy law and any agreed restrictions. For commercial and business photography, the scope of permitted use may be further defined in the booking confirmation or license agreement.
Where the client supplies logos, products, artwork, or other materials, the client warrants that it has all necessary rights and permissions for their use and indemnifies Nordlys Fotostudio against claims arising from infringement or unauthorized use, to the extent permitted by law.
8. Data protection and privacy
Nordlys Fotostudio processes personal data in accordance with applicable Norwegian and EEA data protection laws, including the General Data Protection Regulation (GDPR) where applicable. Personal data may include contact details, booking information, payment information, communication records, and photographs of identifiable persons.
Personal data is processed for purposes including:
- Managing bookings and delivering services.
- Communicating with clients before, during, and after sessions.
- Processing payments and maintaining accounting records.
- Storing and delivering images and related files.
- Complying with legal obligations.
Nordlys Fotostudio will implement appropriate technical and organizational measures to protect personal data. Personal data may be shared with trusted service providers, such as payment processors, cloud storage providers, or delivery platforms, where necessary to provide the services and subject to appropriate safeguards.
Where consent is required for specific uses, such as marketing or portfolio publication of identifiable images, Nordlys Fotostudio will obtain such consent separately where required by law. Clients may have rights to access, rectify, erase, restrict, or object to processing, and to lodge a complaint with the competent supervisory authority, subject to legal limitations.
9. Force majeure
Nordlys Fotostudio shall not be liable for any delay or failure to perform its obligations where such delay or failure is caused by events beyond its reasonable control, including but not limited to fire, flood, extreme weather, power outages, strikes, illness, public restrictions, war, terrorism, civil unrest, transport disruptions, equipment failure not caused by negligence, or failures of third-party services.
If a force majeure event occurs, Nordlys Fotostudio may suspend performance, reschedule the service, or cancel the affected booking if performance becomes impossible or impracticable. Any prepaid amounts will be handled fairly and in accordance with applicable law and the circumstances of the event.
10. Changes to terms
Nordlys Fotostudio may update or modify these Terms of Service from time to time to reflect changes in services, legal requirements, or business practices. The updated version will take effect when published or when otherwise communicated to the client, unless a later effective date is stated.
Changes will not retroactively affect bookings already confirmed, unless required by law or expressly agreed by the client. Clients are encouraged to review the current version of the Terms of Service before making a booking.
11. Applicable law and jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Norway.
Subject to mandatory consumer protection rules, any dispute that cannot be resolved amicably shall be submitted to the competent courts of Norway, with Oslo as the agreed venue where legally permissible. Nothing in this clause limits any mandatory right of a consumer to bring proceedings in a court of competent jurisdiction under applicable law.

13. Severability clause
If any provision of these Terms of Service is found to be invalid, unlawful, or unenforceable by a competent court or authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
If a provision is invalid or unenforceable, it shall be interpreted, where possible, in a manner that best reflects the original intent of the parties and the lawful purpose of the provision.
